Society NOC and Maintenance Dues: What to Verify Before Buying a Resale Flat

When you buy a resale flat in an apartment complex, you are not just buying from the seller, you are also inheriting whatever standing the seller has with the apartment owners' association. If that standing includes unpaid maintenance dues, unresolved violations, or a pending dispute with the association, those problems do not disappear at registration, they become yours. A Society NOC, obtained before the sale deed is signed, is what confirms the seller is clear with the association and the transfer can go through without objection.

What a Society NOC Actually Confirms

A No Objection Certificate from the apartment owners' association or the registered society typically confirms three things: that maintenance charges and any special assessments (sinking fund, corpus fund contributions) are paid up to date, that the association has no objection to the ownership transfer, and that there is no ongoing dispute or violation notice against that specific unit. Without this, some associations can, and do, refuse to update their internal records to reflect the new owner, which causes friction over amenity access and voting rights well after you have moved in.

Why This Is Not the Same as Khata Transfer

Buyers sometimes assume that once Khata transfer is done with the BBMP, the ownership question is fully settled. Khata transfer is a civic record update for property tax purposes. The Society NOC is a separate, private-law matter between the buyer and the residents' association, and one does not substitute for the other. A flat can have a clean khata and still have outstanding dues at the society level.

What to Check Before Paying the Advance

  • A written statement of accounts from the association showing zero pending dues against the specific unit
  • Confirmation of no pending litigation or notice issued to the current owner
  • Whether the association's bye-laws require its consent before a sale, and if so, has that consent been sought
  • Sinking fund and corpus fund contribution status, which some associations calculate separately from monthly maintenance

What If the Society Refuses to Issue an NOC

A refusal is not always a dead end, but it needs to be understood before you proceed. Sometimes it reflects a genuine dispute, unpaid dues the seller disputes, or an ongoing violation. Occasionally it reflects an association acting beyond its powers under the Karnataka Apartment Ownership Act, in which case the buyer's lawyer can advise on whether the refusal is even legally valid. Either way, proceeding to registration without resolving it means inheriting the dispute.
