RERA Complaint Services We Handle

The Real Estate (Regulation and Development) Act, 2016 gives home buyers strong legal rights against builders. Karnataka RERA (K-RERA) adjudicates complaints and can award interest, compensation, and refunds within strict timelines.

Our lawyers assess your case, prepare detailed complaint petitions, represent you before the Authority, and pursue appeals to the RERA Appellate Tribunal if needed.

🏗️
Delayed Possession Complaints Claim interest at SBI MCLR + 2% for every month of delay from the promised possession date. RERA mandates builders to compensate buyers when they fail to deliver on time.
🔨
Defective Construction & Quality Issues Builders are obligated to fix structural defects and quality issues for 5 years after possession. If they refuse, RERA complaints can compel rectification or compensation.
💰
Refund with Interest If a buyer wishes to withdraw from a delayed project, RERA entitles them to a full refund of all amounts paid with interest. We file and pursue refund complaints before K-RERA.
📄
Agreement & Disclosure Violations Builders who deviate from the registered plan, change specifications without consent, or misrepresent project details can be held liable under RERA Sections 12 and 14.
🏢
Unregistered Project Complaints Builders selling projects without RERA registration violate Section 3 and can be penalised up to 10% of project cost. We file complaints against unregistered projects.
⚖️
RERA Appellate Tribunal Appeals If the RERA Authority's order does not give full relief or the builder appeals, we represent buyers at the Karnataka RERA Appellate Tribunal to protect their interests.

Frequently Asked Questions

Common questions about filing RERA complaints in Bangalore

How do I file a RERA complaint against a builder in Bangalore?
RERA complaints in Karnataka are filed with the Karnataka Real Estate Regulatory Authority (K-RERA) online through their portal. You must submit a complaint petition with details of the builder, project, the violation, and the relief sought. You will also need to pay the prescribed filing fee. Clawrity prepares and files the complete complaint petition on your behalf, including all supporting documents.
What compensation can I get for delayed possession under RERA?
Under RERA, buyers are entitled to interest at the rate of SBI MCLR + 2% per annum on all amounts paid, from the promised possession date until actual possession or refund. This interest accumulates monthly, so significant delays can result in substantial compensation. In cases where buyers choose to withdraw from the project, they are entitled to a full refund of all amounts paid along with this interest.
Can I file a RERA complaint if the builder is not RERA registered?
Yes , in fact, selling a project that should be registered under RERA without registration is itself a violation (Section 3 of RERA). Such builders can be penalised up to 10% of the estimated cost of the project. Buyers can file complaints before RERA, and the Authority can also initiate suo motu action against unregistered projects.
What is the time limit to file a RERA complaint?
RERA does not prescribe a strict limitation period for complaints, but as a practical matter complaints should be filed as soon as the violation becomes apparent. For delayed possession, you can file as soon as the agreed possession date passes. Waiting too long may weaken your case, so early filing is advisable.
Can the builder appeal against a RERA order?
Yes. Both buyers and builders can appeal against Karnataka RERA Authority orders to the RERA Appellate Tribunal within 60 days of receiving the order. If the builder appeals an order in your favour, Clawrity represents you before the Appellate Tribunal to defend your relief. Further appeals lie to the High Court on questions of law.
