Can an NRI buy property in Bangalore?
Yes. NRIs (Non-Resident Indians) and OCIs (Overseas Citizens of India) can purchase residential and commercial property in India without RBI permission. However, they cannot purchase agricultural land, plantation property, or farmhouses without special RBI approval. Payment must be made through NRE, NRO, or FCNR accounts , not through foreign currency brought into India. All transactions must comply with FEMA regulations.
How much TDS is deducted when an NRI sells property in Bangalore?
When an NRI sells property in India, the buyer is required to deduct TDS at 22.88% (20% surcharge + cess) on the entire sale consideration , not just the capital gain. This is significantly higher than the 1% TDS applicable when a resident Indian sells. NRIs can apply to the Income Tax department for a lower TDS certificate if the actual capital gains tax liability is less, which Clawrity assists with to prevent excess deduction.
Can NRIs repatriate money from selling property in India?
